Chile: New minimum wage from January 1, 2022

As of January 1, this year, the minimum wage for workers (18 to 65 years old) increased from $337.000 CLP (419,18 USD) to $350.000 CLP (435,87 USD.) In the case of workers under 18 years of age and over 65 years of age, the amount set by law is $261.092 CLP (325,15 USD.)

This increase is established in Law No. 21,360, article 7, which sets forth the minimum wage increases in 2022 from January 1, a figure linked to the seasonally adjusted Monthly Index of Economic Activity (IMACEC, in Spanish.)

The Central Bank of Chile determined that the seasonally adjusted IMACEC for November 2021 was 123,4 and 115,6 for May 2021, resulting in a growth of 6.77%.

As a result, according to article 9 Law No. 21,360, the new amounts of the minimum monthly income were set by Decree No. 2, 01.06.2022, of the Ministry of Finance, published on January 15, 2022.

These are as follows:
a) Minimum monthly income for workers over 18 years of age and up to 65 years of age: $350.000 CLP (435,87 USD.)
b) Minimum monthly income for workers under 18 and over 65 years of age: $261.092 CLP (325,15 USD.)
c) Minimum monthly income for non-remunerative purposes: $225.606 CLP (435,87 USD)

In addition, the law establishes the new amounts for the payment of family and maternal allowance, which are as follows:
a) From $14.366 CLP (17,89 USD) per dependent relative for beneficiaries whose monthly income does not exceed $366.987 CLP (457,02 USD.)
b) From $8.815 (10,98 USD) per dependent relative for beneficiaries whose monthly income exceeds $366.987 CLP (457,02 USD.) and is less than $536.023 CLP (667,53 USD.)
c) From $2.786 CLP (3,47 USD) per dependent relative for beneficiaries whose monthly income is greater than $536.023 CLP (667,53 USD) and less than $836.014 CLP (1041,11 USD.)
(d) Persons whose monthly income is greater than $836.014 CLP (1041,11 USD) are not entitled to these allowances.

Meanwhile, the amount of the family allowance will be $14.366 CLP (17,89 USD.)

Upon entry into force, employers shall pay these amounts retroactively in the salary due at the end of the month or in the fortnight of February, subject to agreement between the employee and the employer.
